S. Korea Wins WTO Case against US Trade Measures

The World Trade Organization(WTO) has ruled in favor of South Korea in a dispute against the United States' high tariffs based on "adverse facts available."

The Ministry of Trade, Industry and Energy said on Thursday that the WTO ruled in favor of Seoul on eight cases of Washington's tariffs on South Korean steel and power transformer products. 

The U.S. has been slapping significantly high tariffs on some South Korean products by applying the "adverse facts available" provision since May 2016.

The provision allows extremely high anti-dumping and countervailing tariffs if an accused company fails to provide data demanded by authorities.

South Korea raised issue with the U.S.' use of the provision through various channels and finally filed the dispute with the WTO in February 2018 as the U.S. continued to levy high tariffs.
