Legal Experts: Prosecutors Likely Suspect Yoon Led Insurrection

Legal experts say President Yoon Suk Yeol is highly likely to face accusations of leading an insurrection. 

According to sources in the legal community on Tuesday, prosecutors stipulated in the pretrial detention warrant for former defense minister Kim Yong-hyun that Kim conspired with Yoon to incite an insurrection with the aim of undermining the Constitution. 

The prosecution accused Kim of playing a significant role in acts of treason. 

Under the Criminal Act, people who take part in acts of insurrection or treason are subject to different levels of punishment depending on the roles they played.

Prosecutors distinguish between the ringleader, someone who plays a key role and others who simply take part.

Observers say the wording in the warrant for Kim suggests prosecutors view Yoon as the ringleader in this case. 

They say prosecutors are likely to focus their investigation on whether Yoon declared martial law in an unconstitutional manner with the aim of leading an insurrection by issuing orders to his subordinates, including the former defense minister.
