A motion to invoke a law on special prosecutor investigations to scrutinize the December 3 martial law declaration has passed the National Assembly.
The motion invoking the 2014 law on special probes passed a plenary session Tuesday, with 210 out of 287 lawmakers in attendance voting in favor, and 63 in opposition, while 14 others abstained.
Representatives of the ruling People Power Party also participated in the voting.
The motion mandates a special investigation into President Yoon Suk Yeol, accusing him of leading an insurrection by declaring martial law in violation of the Constitution, and of interfering with the Assembly’s constitutional right to put an end to martial law.
Former defense minister Kim Yong-hyun is also included in the mandate on suspicion of advising the president to declare martial law.
Others mentioned include former martial law commander Park An-su, all Cabinet members who attended a Cabinet meeting prior to the declaration, Prime Minister Han Duck-soo, former ruling party floor leader Choo Kyung-ho and Defense Counterintelligence Commander Yeo In-hyung.
The 2014 law enables parliament to launch an investigation without having to introduce new legislation, which means it would not be subject to a presidential veto.
