Court to Deliberate Top Prosecutor's Injunction Request Next Tuesday

The Seoul Administrative Court will deliberate next week on an injunction filed by Prosecutor General Yoon Seok-youl to halt the two-month suspension he received from a Justice Ministry disciplinary committee.

The deliberation hearing will begin at 2 p.m. next Tuesday, and the court will listen to both sides and decide whether to stop the suspension or not.

Yoon reportedly claimed in his suit that there were procedural flaws and illegality in the formation of the panel and its proceedings, and the reasons cited for his disciplinary action were also untrue.

His lawyers also argued the damage inflicted by the two-month suspension cannot be compensated in monetary terms and that the independence and neutrality of the prosecution has also been compromised.

The top prosecutor filed for a withdrawal of the punishment and an injunction on Thursday, a day after President Moon Jae-in endorsed the panel’s decision upon recommendation by Justice Minister Choo Mi-ae. 

The panel reached the decision in the early hours of Wednesday, declaring Yoon guilty of four out of six counts of ethical and legal misconduct, after a marathon session that began on Tuesday.
