Two members of the recommendation panel for the chief of the Corruption Investigation Office for High-ranking Officials(CIO) have appealed the Seoul Administrative Court’s dismissal of an injunction to suspend the nomination.
The appeals case will now move to the Seoul High Court, which will review the lower court's decision.
The two panelists representing the main opposition People Power Party(PPP) - one lawyer and one law school professor - filed the injunction request and a separate lawsuit seeking to invalidate the efficacy of the panel's recommendation.
The Administrative Court said Thursday that the injunction, which was to suspend the validity of the recommendation until a court ruling was out on the plaintiffs' lawsuit, was illegitimate because the lawsuit itself was unlawful.
The committee recommended two finalists to head the CIO last month and President Moon Jae-in nominated one of them, Constitutional Court researcher Kim Jin-wook, for the post.
The plaintiffs took issue with the recommendation being made in the absence of their veto rights.
