Prosecutors have requested a pretrial detention warrant for the head of the Army Special Warfare Command, who allegedly deployed troops to the National Assembly when President Yoon Suk Yeol declared martial law on December 3.
The prosecution's special probe team said on Sunday that it filed the request the previous day with the central regional military court against Kwak Jong-keun on charges of treason, abuse of power and others.
Kwak is accused of colluding with Yoon, former Defense Minister Kim Yong-hyun and Defense Counterintelligence Commander Yeo In-hyung to incite an insurrection with the purpose of subverting the Constitution.
Kwak earlier testified that Yoon ordered him to break down the doors and drag out lawmakers from the National Assembly building during martial law operations, saying that the quorum did not appear to be met yet.
The special warfare commander claimed that he did not follow the order.
