Samsung Electronics Seeks to Nullify Rights to iPad Design in Europe

Samsung Electronics says it has filed an application with a European Union agency to nullify Apple’s iPad’s exclusive design rights in Europe.

The electronics giant said Wednesday that it filed the application in Spain on August ninth at the Office for Harmonization in the Internal Market.

The agency manages the rights to trademarks and design of all European Union member nations. If Apple’s rights are ruled void, Samsung Electronics will be very conveniently placed in design-related lawsuits in Europe.

Samsung is currently in a legal battle over patent infringement claims made by Apple that a German ruled in favor of in August, banning the sale of Samsung’s Galaxy Tab computer.

The Korean companies move to void Apple’s iPad rights in Europe is likely directed towards lifting the sales ban on its Galaxy Tab.
