Part of a patent lawsuit filed by Apple against Samsung Electronics has been thrown out.

A San Jose, California federal court dismissed Apple’s claim Tuesday, local time, that Samsung Electronics misrepresented its intent to license certain patents on fair terms. The U.S based company had filed for a temporary injunction to ban sales of Samsung’s devices for alleged patent infringement.

The court, however, did not make a ruling on Apple’s demand to ban sales of Samsung’s Galaxy smartphones in the U.S.
