German Court Rules in Favor of Samsung over Apple in Design Rights Suit

Germany’s Regional Court of Düsseldorf has denied Apple’s appeal for an injunction to ban the sale of Samsung Electronics’ Galaxy Tab 10.1N tablet PC.

Bloomberg news agency said the German court rejected the bid for an emergency ruling on Thursday in a case where Apple invoked a European design right.

In its ruling, the regional court said “the Galaxy Tab 10.1N now sufficiently differs from the form Apple has registered as a design right,” adding that “Apple’s iPads and Samsung’s Galaxy Tab 10.1N now are two competing products of equal value.”

With the court’s decision, Samsung Electronics will be able to continuously sell its Galaxy Tab 10.1N in Germany.

Samsung hailed the court’s decision and said it has been clearly proven that the Korean electronics firm did not violate intellectual property rights as claimed by Apple.
