A Dutch magazine says Apple presented concocted images in the process of applying for a preliminary injunction against the sale and marketing of Samsung’s newest tablet PC in the European Union (EU).
According to Dutch information technology magazine, Webwereld, Apple submitted to a German regional court pictures of Samsung’s Galaxy Tab ten-point-one and Apple’s iPad Two side-by-side, claiming that the two devices are practically the same.
The magazine said it found that the image of the Galaxy Tab ten-point-one had been manipulated from an aspect ratio of one-point-46 to one-point-36, or closer to the iPad's one-point-three.
The report said “Apple and its lawyers have, perhaps inadvertently, misled the judge of a Düsseldorf court by filing flawed evidence of the similarity between the iPad Two and Samsung's Galaxy Tab ten-point-one tablets based on an inaccurate picture.”
Meanwhile, the preliminary injunction that the German court placed on the sales of the Galaxy Tab ten-point-one in the EU has been partially lifted, allowing the product to be sold in Europe with the exception for Germany.
Last week, the Regional Court of Düsseldorf granted Apple a preliminary injunction against the sale and marketing of Samsung’s newest tablet PC in Europe. The action did not apply to the Netherlands, where Apple has issued a separate complaint.
The case between Samsung and Apple is set to undergo another hearing on August 25.
